KIWI CRUSADERS AWARD CONTEST OFFICIAL RULES –
NO PURCHASE NECESSARY.  VOID IN PUERTO RICO AND WHERE PROHIBITED

1. OPEN TO: residents of the 50 United States and the District of Columbia (not including Puerto Rico), 18 or older as of date of entry, except family and/or household members of employees of May Media Group, LLC, Fruitabu, their parent companies, affiliates, subsidiaries, advertising and promotion agencies and public relations agencies. This offer is void in Puerto Rico and wherever prohibited and subject to all federal, state and local laws.

2. HOW TO ENTER: Individuals, 18 or older as of date of entry may nominate {on behalf of themselves or their child(ren)} any public or private pre-K, elementary, primary or secondary school or complete school system within the Fifty (50) United States and the District of Columbia (not including Puerto Rico), by visiting www.kiwimagonline or www.myhealthyschool.com (“web sites”) between 2/15/08 and 12/31/08 and completing the online entry form as prompted.  To enter via mail: download an entry form at either of the above web sites, complete the entry form and mail in a hand-addressed stamped envelope, to: Kiwi Crusaders Award Contest, c/o May Media Group, LLC, KIWI Magazine, 242 Terrace Blvd. Suite F-1, Voorhees, NJ 08043.  Contest ends and entries must be received no later than 11:59:59 pm ET on 12/31/08. Mechanically reproduced mailed entries are void.

3. PRIZES: There will be three Grand Prizes (one per school category as follows: 1) Preschool; 2) Public School/School System K-12; and 3) Private School/School System K-12) of a $3,500 check and a feature story in KIWI Magazine about each winning school category and its corresponding meal programs. 

4. JUDGING: Entries will be judged, to determine the winners (as described above), based on the following judging criteria: Use of natural and organic products (20%); Use of fresh fruits and vegetables (15%); Nutrition policy/program and education (20%); Healthy vending machine policy (10%); Overall nutrition; low-fat, whole grain, sugar (20%) and Meal options; vegetarian, non-dairy beverages, culturally diverse meals (10%); nominator’s essay (5%). Winners will be determined by a panel of health & nutrition experts, selected by KIWI, whose decisions are final on all matters relating to this contest. In the event of a tie, tied entries will be re-judged based solely on Overall nutrition.  All Prizes will be awarded, provided a sufficient number of eligible entries are received per school category.

5. WINNER NOTIFICATION: Winners will be notified by mail by 4/1/09. Prizes will be awarded in the name of the school or school system, as applicable. Entrant as well as winning school principals or school system superintendents will be required to complete a prize acceptance forms and affidavits of eligibility and release (including school’s taxpayer ID#) prior to prize award.  All Prizes are not transferable; no substitutions are allowed, except by the sponsor who reserves the right to award a prize of equal or greater value. Taxes, if applicable, related to the prize are the responsibility of the individual school or school district. No responsibility or liability is assumed for damages, losses or injury resulting from acceptance or use of any prize. 

6. GENERAL:  Contest is governed by the laws of the State of New York.  Any and all disputes relating to this contest shall be resolved solely within the Courts of applicable jurisdiction in the County and State of New York.  Entries become the property of May Media Group, LLC and will not be acknowledged or returned. Entrants/winners acknowledge and agree that their entries become the property of May Media Group, LLC, which thereby has the right to edit, adapt, modify, reproduce, publish, promote and otherwise use entries in any way it sees fit without any compensation to entrant whatsoever. By entering this contest entrants/winners (Winning school principals or school system superintendents) agree: (1) to release the Sponsor and its agents from all liability, loss or damage arising out of their participation in the contest and with respect to their acceptance and use/misuse of the prizes; (2) to be bound by the Official Rules; and (3) to the use of their school or school system names and likenesses for advertising and promotional purposes solely in connection with this promotion, in all media worldwide (including online) without additional compensation, except in TN and where otherwise prohibited by law.  No responsibility is assumed for lost, misdirected, illegible, damaged, postage due or late entries or mail. No information regarding entries or judging will be disclosed.  Sponsor and judges not responsible for late, lost, stolen, damaged, incorrect, incomplete, illegible, garbled, misaddressed, or misdirected entries, misrouted or scrambled transmissions or communications, for errors, omissions, interruptions, deletions, defects, or delays in operations or transmission of information, in each case whether arising by way of technical or other failures or malfunctions of telephone, Internet, computer hardware, software, communications devices, or transmission lines or data corruption, theft, destruction, unauthorized access to or alteration of entry materials, loss or otherwise.  Sponsor disclaims any liability for damage to any telephone or computer system resulting from participation in, or accessing or downloading information in connection with, this Contest, and reserves the right, at its sole discretion, to modify, cancel, terminate or suspend this Contest should any virus, bug, technical failures, unauthorized human intervention or other causes beyond Sponsor’s control corrupt or affect the administration, security, fairness or proper conduct of the Contest.  In the event of any cancellation, termination or suspension, a notice will be posted and judging will take place from among all eligible e-mailed and mailed entries received prior to such time. Sponsor reserves the right, at its sole discretion, to disqualify any entrant if his or her fraud or misconduct affects the integrity of the Contest.  Entries will be considered made by the authorized account holder of the e-mail address submitted at time of entry.   By submitting an entry in the contest, you acknowledge and agree that Sponsor shall be permitted to use your entry data for marketing purposes consistent with their privacy policies and applicable law.  All entrants further agree that in the event of any third party claims, damages, losses or injuries, arising from or relating to this Contest, they will indemnify Sponsors from any and all such claims, including the attorneys' fees related thereto.  By accepting prize, winner agrees to release Sponsor, Fruitabu, their respective directors, employees, officers, and agents, including without limitation, their advertising and promotion agencies and public relations agencies, from any and all liability, loss or damages arising from or in connection with the awarding, receipt, and/or use or misuse of prize or participation in any prize-related activities.  Sponsor is not responsible for typographical, printing, or other inadvertent errors in these Official Rules or in other materials related to the Contest.

7. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATIONS OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW.
